Booking Fee:
A non-refundable Booking Fee of £200 is charged when the Client signs this contract. This fee is deducted in full from the TOTAL price.
Payments:
Following payment of the booking fee the remaining balance is due to be paid 30 days before the date of the event as detailed in the schedule. Payment for additional images is to be made when they are ordered.
Display:
The Client hereby allows Equinemoments Photography to display any image included in this contract in their studio, portfolio, literature, event exhibitions and advertising. Equinemoments Photography will make no use of the images for other commercial reasons except with teh written permission of the Client.
Images:
All image sizes are nominal. Equinemoments Photography will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certian dyes and materials, especially man made fibres. It is sometimes impossible to capture the exact colour as seen by teh human eye.
Retouching:
Retouching, digital manipulation and artist finishing is available to the Client as an optional extra.
Reorders:
All reorders shall be treated as an extension of this contract adn no responsibility for error will be accepted unlessorders are given in writing.
Copyright:
Any images or copies whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright Designs and Patents Act 1988. It is contary to the Act to copy or allowed to be copied photographically / electonically or by any other means an image created as part of this contract without the permission of Equinemoments Photography in writing.
Licence:
Equinemoments Photography shall be granted artistic license in relation to the poses photographed adn locations used. Equinemoments Photography judvgement regarding the locations / poses and number of images taken shall be deemed correct. Due to teh vagaries of weather and the willingness of subjects it may not be possible to capture all the images requested.
Equinemoments Photography judgement regarding relevance or non-relevance of subject matter shall be deemed correct unless specifically informed. Equinemoments Photography will endeavour to capture as much as what is relevant to teh event as possible. However, Equinemoments Photography cannot guarantee everything will be recorded.
Force Majeure or Act of God:
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Limitation of Liability:
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequntial loss.
Cancellation:
The Client may cancel this contract at any time by giving written notice to Equinemoments Photography but in doing so shall forfeit any monies paid. Should cancellation be received by Equinemoments Photography less than 10 weeks proir to the date of the ceremony the Client shall in addition pay a sum equal to 75% of the contract value. The said sum shal be payable as compensation to the loss Equinemoments Photography would suffer.
Negatives / Digital Files:
Negatives an ddigital files remain the property of Equinemoments Photography.
Complaints:
In the unlikely event of there being any complaints, these should be first raised by the Client with Equinemoments Photography in writing within 21 days from the date of receipt of images.
